1. Agreement to Terms
By accessing or using Novelhalla ("the Service"), operated by Evan Callahan ("we," "us," or "our"), located in Florida, United States, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Novelhalla is a digital book platform. The Service provides access to books via subscription or individual purchase, and the ability to download purchased books in EPUB format.
3. Accounts
To access certain features of the Service, you must create an account. You may register using an email and password or through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep it up to date.
4. Subscriptions and Payments
The Service offers monthly ($5.99/month) and annual ($49.99/year) subscription plans. Subscriptions provide access to all books on the platform for online reading. Subscriptions automatically renew at the end of each billing period unless canceled. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. All payments are processed securely through Stripe. We do not store your payment card information on our servers.
5. Individual Book Purchases
Individual books may be purchased separately for $3.99 each. Purchased books may be downloaded in EPUB format for offline reading and may be shared with friends and family for personal use.
6. Content and Use Restrictions
The Service and its content are protected by applicable laws. You agree not to reproduce, distribute, sublicense, or commercially exploit any content from the Service, except for personal sharing of individually purchased downloads as described in Section 5.
7. User Conduct
You agree not to: attempt to gain unauthorized access to the Service or its systems; use the Service for any illegal purpose; share your account credentials with others; use automated tools to scrape, download, or copy content from the Service; circumvent any access restrictions or digital rights management; or interfere with the proper functioning of the Service.
8. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your right to access subscription content ceases immediately. Previously purchased and downloaded books remain yours.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the accuracy or completeness of any content on the Service.
10. Limitation of Liability
To the maximum extent permitted by law, Novelhalla and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes by posting the updated terms on the Service with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
